Detailed description of the events: 

Cerna Liska along with a few friends of theirs captured Elaina Vale, a fellow terrorist who we've worked with in the past and generally gotten along with. We got contacted by a couple members of her group that told us that she had been captured in Novy so we search the areas around novy, from kabanino and the pub there, to lesnoy khrebet to summercamp and hills around and eventually found them. We all regroup and move in. Initiate, a few of them decide to run so we chase and kill all but one of them. During this the rest of of us release Elaina and have her lead the "trial" or whatever you wish to call it. During this, Kenji Oshiro is told to apologize and refuses repeatedly, he is forced to apologize with the threat of death, and continues to refuse. He gets beated down badly and offered another chance, refuses yet again and gets shot in the leg. As he is being bandaged he either bled out of intentionally pressed respawn.

Either way he showed absolutely no regards for his own life. This is not the first time this has happened and is the way he's handled most hostile encounters where his life is on the line, seems more so an OOC way of "getting back at" the people who outplayed him, as in not giving them the satisfaction of him taking the situation seriously. He has previously received a verbal warning for showing no value for life as well.

Irish initiate as Liska was RP'ing with Sunshine, few run, people are killed, Irish "clean up" after this we are told to line up next to a deer feeder while Elina ask Kenji to step and apologize, IC Kenji's backstory way he is would never bow like that, instead got beat and was unconscious most of the time, so their wasn't much RP with it. When he gets up again he is asked again and refuses and is beat with I assume was a can opener? was hit maybe 15+ times and thus when my OBS crashed in the end killing me.

I wasn't with you under another character. I haven't been close to you. Quite frankly, I'm surprised you managed to mix me up with someone else as my voice is quite distinctive. I haven't switched character for a couple weeks or so.

I have two videos of the situation. I was struggling with my software and stopped it unintentionally quite a few times during RP events yesterday, including this one. I don't recall anything important happening during that time but I was busy swearing at my PC, so I could be wrong. Also, my VOIP is not recorded because it was set to push to talk, but the button was not binded. h

Brief POV: We ran into Liska and Elaina in Novy, Kenji recognized her and initiated on her due to her recent issues with Wallis Childs. I frisked her for her radio outside the church, before we decided on where to take her. We walked her down to the hill opposite the entrance of Novy summer camp. Kenji tortured her for a bit, then the two other people had a go followed by the Liska. As Jitke was just building up his torture RP, the Irish jump out of the bushes. I think about half of Liska run off, including the two people that tortured Elaina. Hoffmeister, Kenji, Danil, myself and someone else who I can't identify and I comply.

The Irish regroup around us, bind some us and move us over. They separate Kenji from us at which point, Elaina shoots him. They move him away from us and demand Kenji crawls like a worm and beg for his life, which he of course refuses. Then Juggernut punches him, Kenji passes out and Juggernut punches him another 14 or so times.

The Elaina speaks to the rest of us hostages, starting with me. She asks if I am one of the reapers, I say no. Asks my affiliations, Lewis adds in that I am a Wolf. Then Lewis hits with a sword, I am under the assumption despite what they're saying here these are not wounds that will permascar as Lewis

Elaina then uses her kill rights and kills Hoffmeister as he is not able to provide a reason he could be valuable to her.

Eventually everyone but myself is either killed or released. Elaina discusses payment with the Irish and when she is not able to provide any, she offers me as payment to one of the Irish members as part of her service, but he declines and I leave with Elaina who releases me shortly afterwards.

My PoV:

I got captured during a Hostage situation with Sunshine.

After they where done shooting the people that ran away the Irish came back and proceeded to tie us all up and take all our weapons.

Shortly after they demanded to crawl through the dirt like a worm and beg for his life.

If i would have done this i would have broken character for the following reasons.

My character was raised in a extremely Strick household following Japanse tradition.

At the scene where they told Kenji to do this was someone that is like family to him, Zhoe Burton.

To lower him self to such a extreme degree would in front of someone that close to him would be worse that death.

In order to stay in character i decided not to comply.

I would like to point out that i was NOT told to apologize.

I was told to crawl over the ground kiss her boots and beg for my life like the animal you are.

As seen in the video at these stamps.

sunshine says " i want to watch you crawl " 

She says "beg for your life" 

That is also the moment where Kenji realises that he will most likely not make it out. it is not uncommon for a person in extreme distress to laugh extremely loud and see something funny in it all. in kenji`s case it was the fact that she thought Kenji was going to lower himself in front of family.

At that point he pretty much came to terms with that fact. 

Juggernut " kiss her boots and beg for your life " 

I would like to point out a that in the started accusation it states that i had to apologize. and it can be clearly seen that was  not the case. 

I tried there to display a state of mind wich is not stable by first replying softly as the fear of death is rising and then in a loud shout when he expected to get shot. That was to hide his fear also something very common in extreme situations. And the grown as i get punched.

juggernut " now have you changed your mind? are you gonna crawl to her like a dog and beg for your life? 

as i come to the state i can respond i release a weak moan and my entire tone changed from before as Kenji has received extensive injury.

i state " i have not changed my mind." in again a weak defeated tone.

Then i got shot and died.

Kenji would maybe do as he was told IF he was the only captive.

However Zhoe burton is as close as family gets in Kenji`s eyes to humiliate your self in front of family is worse than death. 

The Kenji character is build on the foundation of a extremely conservative Japanese upbringing.

One only has to look to history to see that behavior like this was common in Japan even up to this day. 

Anywhere from suicide bombers to ritual suicide it permeates Japanse culture.

To cave to their demands to"crawl through the dirt like the dog your are."  would have forced me to break character.

So i choose to RolePlay over RulePlay.

And as you can see i did RP i displayed a variety of emotional states in the 4 minutes give or take i was not knocked.

I would also like to add that they had numinous different opportunity`s to try to break him in other ways.

Using kenji`s friends against him.

emoting the injuries rather than hurting the avatar.

Torture.

Alright, since Kenji Oshiro would rather die than lower himself to others, especially in front of someone he cares about I take it this is the end of Kenjis story and this was his permadeath. As clearly death is something you took into consideration as we have the value for life rule.

As you clearly state you chose roleplay over ruleplay I'm certainly convinced that Kenji had an admirably roleplayed death, in the forest, after deciding not to lower himself to others. I'm sure he'll be remembered and have people mourn his death, rather than deal with the dishonor.

Is this correct or are you simply abusing the fact you can just respawn and continue, despite the value for life rule that is mandatory to be followed?

As said before, a backstory does not overrule the rules. This has been made very clear on multiple occasions and in a multitude of questions threads.

On the point you make on perma-death.

No i do not intend to perma-death. It is completely my own choice.

I was rushed into a death by excessively shooting and beating my character with brass knuckles dealing excessive amounts of damage from which i could not recover. as shown in the logs  

during all this i RP`d out getting injured and a failing mental fortitude as i pointed out in my previous post.

In the few minutes i was conscious i rp`d out going from loud defiance to getting to a breaking point as seen in the video evidence.

I did not get enough time being awake to RP much other then those few statements. 

The lack of emoted torture cut all RP short.

In this situation you could also have used Kenji`s friends as leverage to get Kenji to do what you want, or emoted all the abuse in favor of RP.

instead i got dealt extensive harm by the gunshots and the repeated while unconscious. The people involved should know about accumulating damage in form of shock and blood loss. and thus cutting short any form of RP i could have done to RP out Kenji breaking. The group you where with also knew i was carrying a large amount of medical supplies anything from saline to bandage rolls, all of which could have been used to extend the RP.

During the whole event i was only conscious for about 5 minutes or so from the start of the line up to my death.

The reviewing party have come to the conclusion that Kenji Oshiro will be found guilty for NVFL. From your PoV we understand that you play a traditional Japanese character but at the same time we decided that this can't be used as a "Get out of jail free card". Every time something like this might occur for your character in the future.. 

From the situation, you died after you was given a few chances to do what was asked by the hostile party. After receiving a pretty big beating you still choose not to comply to the demands. You was staying in-character and we understand that's the stubborn kind of person your character perceives to be. But by not doing as they asked you made the choice to take death as an option. 

We will never force you to permanently kill your character as that will be always your choice and we do not control the way you role-play but you said your character will not be permanently killed from the situation that occurred. Which means your character will not receive any development from what happened. If you had chosen to take the in-character embarrassment you would of been open to much more opportunities for yourself.  For an example you could of role-played out that you felt like you have dishonoured your family name and you need to gain back that honour. Role-play out that you felt like you was embarrassed to do that in front of one of your family members and you felt like you failed them personally by doing that.  

In future you should consider looking at situations like this from an in-character perspective and thinking about the opportunities you would gain from these kind of scenarios. Always value your characters life rather than taking the easy route out.
