Detailed description of the events:

Me, Madison and Lorenzo along with some random tag alongs (Gary Robinson) were traveling around between Novy/Stary area after RP'ing for a short time. We came across a billboard outside of Stary and decided to deface it and we meet an unnamed Russian (Vasily Krasnav) who proceeds to threaten, belittle and follow us non-stop even after repeated requests to stop following us disregarding the fact he was out numbered and out gunned.

We reached Novy Church where the accused tried to turn the people there against us by lying to the group there (Trust) stating we threatened him leaving out all the "Hostile RP" made during the trip but the group was informed we were coming. Just before we got there, one of the people traveling with us threatened (Vasily Krasnav).

(Vasily Krasnav) once again being hostile to the 10+ group around him when someone started to handcuff him and he pulled his AUG and started shooting among the people before rushing me, knocking me unconscious with him dying in the process. I get up after a brief bit of medical RP from a member of the Trust trying to leave but my legs are broken only to be killed by (Gary Robinson) who ended up dying after killing me and Lorenzo LaPlaca.

After this there was a moment where the phrase "You fucking nigger" you said, unsure if it's relevant or aimed at us. @2:50.

Was outside Novy when this all went down, heard shots but never got there in time. We got all of the dank gear though.

First of all, Kevin only shot at 4 people. The 4 were apart of the same dynamic group. He was not shooting at anyone else and ONLY shot because they improperly initiated on him. Sorry fam, this is a complete false accusation. You are correct on the other guy calling you an N word, as Boston video proves that, but that wasn't us.

I was not aware that you were with the other people, I thought they were randoms. I had two friends right outside the walls of the church and others in the city. I was not alone.

Nothing much to add that videos won't say. This Russian dude is being mouthy, KNEW it was baiting for an initiation. Kept my gun out for that reason. I was distracted for a moment when someone tried handcuffing the Russian. He started shooting wildly, putting me in fear for the life of all those around me. I raised my M4 and shot a lot of rounds at him after trying to shoot around Madison Mays. He went down, we scruffed around to try and get Cade up, then scuttled it the hell out of there. We heard the gunfight that ensured as we ran off.

For the record, we were all a part of Cades group with my group, as Trust knows him ICly on friendly terms. The dynamic group that was being fired upon included over 11 people, so I support the claim of NVFL. Two on Eleven, not good odds. And I'll continue to consider it as 2, not six, because we only saw two.

Just gonna go ahead and slam dunk my Pov in this counter report.

I was outside Novy (in the fields-ish) omw to back up Vasily. In the immediate Novy Area we had Alex Mane (forum name), Me, Lemon, Jezza, Josh Yao, Boston Donut, Vasily. That's seven. Granted things popped off a little quick and no one had proper time to react or even set up, and by the time it had all happened Kevin was already dead and Boston had not told us over comms so we could not necessarily go running over there guns a blazing because that would of been meta gaming anyways, if your pal had properly initiated there would not have been a problem, but there was absolutely 0 NVFL as he believed he had backup ready, and that it was two separate groups, as you can see in the video there is only 1-2 people that even raise there guns when he reacts.

- I want to add that I noticed the uttering of "thats right nigger" at 2:47 before Boston posted his video and we thought it was you guys and you can tell from the quality of the audio that it was in game and not TS considering you can hear me talking and the quality difference. Also you can hear all of us talking and our voices and just distinguish its not us so nice try to blame us with that. It was obviously Jarek just listen to his voices in the videos that will be / are posted.

You all acted like separate groups, there is no way that I would know you are together. In my mind there was only 4 of you in the dynamic of the man who hand cuffed me. I had 6 friends with me... I don't see how I could have known. Perhaps if you made your numbers apparent, and told me "Put your hands up" Things would have gone differently.

Huh... Conflicting. Trust scouted out the edges of town directly around the church, nothing and nobody. There was nobody just outside the church walls when the incident happened, otherwise we would have gotten lit up. But we didn't. We ran off and took no gunfire. So...Glad to smooth that out.

Look at Boston's video of Kevin getting killed. At 0:25, you can hear Apolloakajosh (Josh Yao) asking what was going on. Shoo Ping Yao was close by Josh. You claim NVFL, though the group that cuffed Kevin improperly acted separate from your group, meaning that Kevin or Boston had no idea that the number of hostiles were actually 10+ rather than 4. You can't claim NVFL when you don't show your numbers or act as if you are not apart of the situation. We had the same number of people in Novy as what we thought were the hostiles and 3 more outside of Novy. Also your scouts must be pretty blind then, because we were definitely there.

POV:

I was in Novy sitting with the Trust and some friends, when all the sudden a group of people drop in with a "Ruskie" and he's being very hostile. I talk with them for a few minutes then I go lean on a tree and just watch the fire. After a few moments he starts shooting everyone with his automatic weapon, I felt my life was in danger as he was turning his firing weapon towards me, so I shot him with my Winchester and he hit the dirt.

The video pretty much sums up everything.

Madison May POV:

My POV is going to be about the same as Totallynotacow but figured I'd write it since I was directly involved. 

After meeting some of the french in novy we decided to head off towards stary and onward as I had plans to meet up with The Trust as Madison hadn't seen them in awhile. Before we even enter Stary someone comments on that billboard of the man with the comb over in which we have a few jokes about how Cade would look with a comb over, until we decide to add a bigger mustache and unibrow. That was when Vasily showed up. The RP with him was limited at first as he didn't say anything from my perspective until after Jay Wong had walked by and Cade, being Cade, telling him "Hi and Bye" before walking off. At that time my character asked him why he was that way with Jay and he informed her of an incident with their friend Jena and proceeded to make a comment about Jay Wong. 

That was when Vasily started with his Hostile RP. Claiming how amazing Jay Wong was and that he could get him on the radio and have him come back. That made us assume, along with the mask, that he was apart of Wongs group. We then proceeded to head back to Novy as too many have gone through Stary and Vasily continued to follow. As in the video we asked him multiple times to leave and even tried to go a different direction ourselves. Giving up as most of us needed water we headed to the pump where we ran into The Trust. That was when Vasily proceeded to try and convince The Trust that we were doing all these 'mean' things and even mentioned being informed that he would be shot in the head. We continued with some RP. I tabbed out for a moment to try an ask a question to Staff and as soon as I tabbed back in there was a man running past me shooting his gun into the ground. From there I took cover finding out that they had gunned the man down that we assumed was part of Wongs group I informed them that Wong was too far from here last time we saw him and The Trust wanted to get everyone out. We stayed behind long enough to see Cade get back on his feet where they started to RP out him being injured. From then I was escorted from the area and was not around for the rest. 

Also reading some of the back and forth saying that it was our fault we didn't make it known we knew The Trust so you assumed it was just the four of us is really an odd thing to say. As Gary traveled with us for a good two hours and decided to be the inside man clearly making sure no one knew the two of them were together. Even going so far as spitting on his friend's body before blasting two of the remaining three guys away. From my point of view this could've been RPed out and turned into some amazing roleplay but it was cut short because of the handcuff panic where it was fire first ask questions later.

Verdict:

Gary Robinson - Multiple Rulebreaks [NOT GUILTY]

Reason:

After reviewing this report we have agreed that Gary Robinson is not guilty of the rulebreaks listed in this report. From the evidence provided and all the views of those involved we see that he acted on IC information which he gained by watching the situation as it unfolded. He saw a member of his group killed in an altercation, planned out how to react to the crowd and waited for the strategic moment the group divided.

He then took this chance to get revenge for his friends death using the KoS rights he had gained and was almost successful. We believe that his planning and patience allowed him to get his revenge and that he was unfortunate that server side issues resulted in his death.
