Detailed description of the events: I was running towards Novy to meet up with my friend Boston, when he then informed me of a large group of people outside of Stary. I walk up to the people and begin to engage in hostile RP, with Boston as an inside man. After about 10 mins of hostile RP, we finally reach Novy church. Where Jarek says " Here's what's going to happen, were going to walk past your church, your going to stop in your church, if you don't stop in your church, were gonna fucking kill you" At the church we encounter another large group of people and I engage in more hostilities. Whilst engaged in hostile RP, Jarek attempts to tie me up, I run and begin to shoot at him when his friend kills me.

Gary Robinson PoV:

After traveling with some people for a while, we walk to Stary, where we see a billboard. One of the men decides to make the guy on the billboard look 'Hitler-Esque'... so he RP's drawing a mustache on the billboard...

So, I inform Vasily over the radio that they're vandalizing his beautiful country. We agree that I will be inside man and that Vasily will start Hostile RP. In the event that they initiate, I would walk off and snipe them with my LongHorn...

So... when we walk off from the billboard, one of the men insults Jay Wong, to which Vasily gets in their face even more. The HostileRP continues for quite some time, before we reach Novy. In the time it takes to reach Novy, Jarek Hynek initiates twice, granting us 2x KoS Rights...

At Novy, everyone gets in Vasily's face, so we call in some backup. While on their way, Jarek starts to handcuff Vasily. Vasily tries to shoot him, but misses. A short gunfight breaks out and Vasily ends up dying. The Trust/Majority of other people start leaving, and only the three hostiles that opened fire are left alive at this point.

I wait for everyone to be at the perfect moment to open fire. The British gent empties his mag into Vasily's body, so he is left defenseless, while the man with the cowboy hat has his axe out, and Jarek has his out too.

Nothing much to add that videos won't say. This Russian dude is being mouthy, KNEW it was baiting for an initiation. Kept my gun out for that reason. I was distracted for a moment when someone tried handcuffing the Russian. He started shooting wildly, putting me in fear for the life of all those around me. I raised my M4 and shot a lot of rounds at him after trying to shoot around Madison Mays. He went down, we scruffed around to try and get Cade up, then scuttled it the hell out of there. We heard the gunfight that ensured as we ran off.

For the record, we were all a part of Cades group with my group, as Trust knows him ICly on friendly terms. The dynamic group that was being fired upon included over 11 people, so I support the claim of NVFL. Two on Eleven, not good odds. And I'll continue to consider it as 2, not six, because we only saw two.

So to sum things up. He thought there was only 4 that was with the guy that randomly decides to falsely initiate on him and handcuff him. He has 6 in the area, he also has an automatic with a 60 round mag in it, and one of his back up was right there. 2v4 from the start , now factor in the guy handcuffing him had no gun out that's one less threat. thats 2v3. those are decent odds considering you didn't even know that boston was with him, there is absolutely no NVFL here, these are just counter salt report accusations because you guys decided to break a rule on us, and our group did the best to cope with it that we could on the fly, while not breaking rules. Just take this into consideration as well

30 of those rounds went into the dirt because Kevin had the mouse1 bug right after he shot (you can clearly tell in the video as well) at the first guy. Sorry we decided to control a really dumb bug and NOT shoot anyone else. Kevin didn't spray into the group and waited until he passed by who he thought wasn't involved. He only shot at the guy who tried to restrain him and the guy who started shooting at him first. The reason Boston was the only one who took action is because we had no idea who was who and who was hostile and didn't want to shoot innocents, but I guess you all were hostile. You claim NVFL in your report, yet you never act as if you are with the accused part in ours. In fact, people even say that they should leave before Wong's group arrives while one of who I guess is your dynamic group members is down. I believe chief says "There is no time. You can't save him" while the other group says "we can't leave him" and start to help him. You guys don't seem to act like the same dynamic group now do you? I didn't know groups were accustom to leaving group members unconscious without helping them. Would you want us to spray into a big group after not knowing who is who?

After reading through the silly comments made by myself last night, I would like to apologize for my behavior. I had been up much later than usual last night, and I acted in a way that I should not have acted in. That was foolish, and I was attempting to make light of a situation to make people feel better. That is obviously not the route to go, especially in a formal report where I (and everyone else) is expected to act seriously.

This will not happen again, and I am sincerely sorry.

I have been told by Ark to upload uncut video evidence (which is rendering at this point). The video evidence will be PM'd to Ark.

In the meantime, I would also like to clarify on my poorly written PoV:

1. There were only two initiations from Jarek, and none of them were 'Put your hands up', or any kind of initiation to warrant handcuffing someone. So that was an invalid initiation. It can be seen on the second of the two videos at 0:02, when Vasily says 'What the fuck?'.

3. You can hear Jarek call me a 'Nigger' at 2:49 of the video, which is obviously unnecessary racism and didn't come from our TS. There is a quality difference between in-game and TS. Plus, in TS, we immediately discuss the rulebreak that happened on Jarek's end. We weren't discussing anything to warrant the use of the N word.

In the time it took to write this, the video has finishes rendering and uploading. It will be PM'd to Ark.

As i have watched and read over the Other POV's I would like to point out that I had a pumpkin in My hand as as i pointed out In teamspeak I had drinks and food in my inventory next to my rope and other items. I had said that it was an accident and i did not realize that i had a rope in my hand and clicked middle mouse Which is usually used to Confirm an action. A few of us had came into teamspeak and talked about it for a few minutes. After being called a bullshitter i offered to compensate with their gear back and most of mine. I was also going to type in OOC that it was an accident but i did not have time as i saw the AR was being pulled out. As far as the "N" word comes into play i did not realize that my mic was on as i was trying to hit sprint to leave the Area before others came to the scene. I Understand that using that type of language in-game is reason for a Perma-Ban And i can promise oyu that it wont happen Again. i would also apologize as i have Anger issues and Short-term memory loss if there are anymore questions about past events i will be in teamspeak and will try to answer then to my best Ability.

In my video at 4:35 you say to me "Okay, that's it" right as you tie me up. Why would you say that then attempt to feed me pumpkin like you claim? When we talked to you in TS you were repetitively claiming you don't remember the situation 5 mins after it happened. Even if you didn't mean to drop the N word IC like you claim, you should try to avoid saying such racial comments.

While you did initiate on the OP clearly, your excessive OOC is evident in the chat logs and is peppered over an hour as you go OOC with the standard //. While in form there is nothing wrong with going OOC if it is an emergency. However, we as staff fail to see the nature of your comments being in an emergency styled state and are lacking in urgency to qualify as such. This is mainly due to the emoticons displayed here.

Beyond this, your comment towards Boston warrants the full extent of your punishment. You are not only using a derogatory term towards another person, but it is done to someone who you had just killed and in and OOC manner as stated in one of your posts. Regardless if it is accidental, it is disgusting and has no place here in our community. Saying this word as you described, accidentally and OOCly. Is still treated as racism towards another community member in our eyes.

In this way the term carries a type of public server mentality with it. Which to us is unacceptable and unwelcome on our servers. As such this warrants your removal from this community due to the nature it was used and historical background behind the said word.

As such, we wish you better luck elsewhere.

You began opening fire after the accused attempted to handcuff you. While it was within your right, the situation was less than ideal for ensuring the survival of yourself. You died shortly after, being shot by a myriad of different weapons from a group much larger in numbers than your own. We feel that you did not express any sort of value for your character's life when you began shooting. As it was very, very unlikely you were going to get very far from where you were once you began shooting. The video confirms this as you clearly did not, dying by the gate which is no more than 20 meters from your original position. 

This, quoted in our rules applies wholesomely in this situation.

In future instances. We ask that you take into account all factors in a situation prior to shooting.
