Detailed Description Of Events: This evening I was patrolling the streets of Zelenogorsk as my character Aleskey Nowak all was quiet and peaceful  until cerberus showed up for the 5th day i believe in a row to wander the town but avoid talking to us other than saying "Hi" and positioning themselves in buildings,alleys and the hills around zelenogorsk with there guns out they once again seemed up to no good. As we talked over the radio  we decided if they asked to put our hands up  we would comply as at the time we where out numbered. It ddint take long for our short dance to end once some CERB members decided to initiate on @Kermie and another member. Unfortunately i didnt hear about my friends peril in town over the radio as i had my radio off at the time as IRL  and IC my character and i suffer from constant miigraines (my characters head injury/Eye injury happened in past RP events making him hard of hearing and suffers from constant migraines)   So when i decided to leave my position on the hill and go back into town i was jumped by @Phoenyxx and asked to put my hands up which i did. Eventually after being disarmed and degeared i was put with the other hostages  and given food/water as apparently we where gonna take a trip east on foot. After some talking and walking we are lead to the forest east of zelenogorsk near the barn and told to pick a tree which i do and soon my fellow hostages join me as we wait for cerberus to make further moves. After a fe seconds of banter and talking to my fellow captives my character dose the following from what i can remember and if any of it is incorrect im sure the mods will have the logs.

Between  that interaction with me and the woman i believe to be phoenixx one of my fellow hostages tried to explain why my charcter was yelling and acting out she and the other cerb members kinda blew it off and never fully recognized it.   

due to concerns of staff bias as they are friends with the accused in my report id like to ask these specific staff members arnt involved.

Alexei POV: I was running around Zeleno trying to kill some infected so I could make money to be able to buy a sweet sweet parka off of the item shop. While running through the city and trying to accomplish this I was told to put my hands up and was brought to a house where I was stripped of my things and given the usual and basic hostageRP. They brought us to the woods where I had to sit next to a tree with the rest of my people and thats where the incident takes place. @Epsilon recently got a head injury and I told the hostage takers this as well as @Phoenyxx who was present. Aleskey then begins to play with some leaves i would assume because he is bored and is told to stop playing with the leaves. He then stops doing so and lets out a very audible "Yes!" to her and her reaction was to kill him.

 

I have video evidence but I have to upload it so please bear with me.

Also @Peril I think he was meaning as a request that these people were not going to be involved and explained why. I understand where you're coming from but it was just a request not a demand.

First of all let's make this very clear from here on out to anyone from the Obrana Národa side claiming staff to be biased:

@Epsilon

You cannot choose which staff member deals with your reports. Administrators do that.

You cannot claim bias because verdicts didn't go the way you wanted them to. If there's obvious bias the Admin team will deal with it. If you have concerns, send a support ticket with proof and concrete evidence.

Currently we have no reason to believe either of the staff members you listed are biased towards either of these two groups. None of them have really close ties or are really affiliated with them.

What's going on Role-players Hope everyone is well. 

Dima Smirnov POV:

I was in Zelenogorsk Just kinda chilling behind PD, My character is very non confrontational and was roped into this military group as he knew how to work a field transceiver radio, he doesn't carry a gun and overall is a super passive character. So I hear someone scream the words most of us dread "EVERYONE IN THE PD PUT YOUR HANDS UP". I am around back and announce to the attackers where I am my hands are up and am coming to the front of the PD building, I walk inside and get taken into custody by some cool guys in orange arm bands. I was searched by I believe @TurkRP and the RP was good to be fair. They had also taken @groovy dingo at some point and we were stripped of weapons and marched south to a house where they had also captured @Panda and @Epsilon. They line us up on a fence and continue to strip our gear and search us once more. While on the fence @Epsilon who is hard of hearing(both IRL and IC'LY) had a hard time listening to instructions while being told to take off his chonky helmet and gets a nice talking to about listening. Then the boys and one girl feed us march us up into the woods. They stop us at a tree and at that point Aleskey is frolicking and fucking about in the leaves the girl doesn't take kindly to his I guess attitude and the fact we are hostages and this dude is having a teenage girl candid photoshoot in the woods with his leaves. Tells him to stop he kinda takes a moment then blurts out YEISSS and is gassed. From there the RP was actually kinda cool and I enjoyed my time RPing with everyone. xoxo

Elmer Adams POV:

I'll start from where I consider this situation to have started, during the initiation in the middle of Zelenogorsk where we took two of the nationalists hostage. Their attitude didn't start off well in my character's books so they were warned by him to cut the shit. Fast forward to a double brown house inside Zeleno, the two hostages have been made safe and lost their radios. I then left them with another member of Cerberus to go assist with the transportation of the other three hostages from the PD. 

I believe the OP was one of the hostages that we took at PD and, bear with me as my recollection of last night is a little hazy, he took his captivity a little less than seriously during transfer. This provoked my character to strike him with the butt of his weapon and warn him to cut the attitude. 

Once we had corralled all the hostages outside the double brown, we fed them, gave them water and then @RP gave them a loud warning that if there was any disrespect, fuck acting or otherwise unpleasant behaviour, it would not end well for them. With that being said, we moved them south-east out of Zelenogorsk towards the sniper barns and into the woods, where Panda's video shows the rest. 

At the point of his death, the OP had been warned twice by myself (one of which you can see in the video), once by Luke and once by Phoenyxx to quit his fuck acting. It was pretty clear from his response to Phoenyxx that he fully intended on continuing his disruptive, annoying behaviour, in violation of our earlier demands.

Thus ends the epic PoV of Elmer Adams, poet, lover and Cerberus Operator.

Greetings staff team,

The initiations get dropped and the hostages get collected south of town to round them up and feed them so we can start moving them. 
OP had since the initiation dropped a really childish and trolling behavior, multiple of my allies warned him to stop this attitude immediately or else be harmed. This can be proven by hitlogs too as he got hit atleast once or twice by the end of a weapon. 

Around 0:15 you can hear OP make a lowkey ooc jab by saying “this is the most they talked to us the past 3 days”, which kinda ruined the immersion for most of us but we tried our best to continue on with the roleplay and warned him once again, this time severly by @Elmo. OP never acted like he was in danger by trolling, even tho there were around 10/15 of us around him and he was a hostage.

OP and allies are commanded to stand by a tree while we wait for the 5th hostage where OP does not show any roleplay or fear and starts playing with some leafs (????). At first we ignore this but i assume he did his very best to show us how uninterested he was and how interesting these leafs were by making another statement in chat.

Phoenyx then warns OP as seen jn the video evidence by @Panda for which i thank him for, OP decided to continue with his trolling by at first ignore 8guns in his face and warning from phoenyx and later on decides to yell suddenly. At this point phoenyx decided to not let the roleplay get ruined by someone who clearly was not interested in roleplaying with us and not valueing his life.

After watching OP’s character page i cannot find anything regarding the head injury and his reason for acting like this either, i assume it was all a lie and a excuse for his trollish behavior.

Meanwhile in the video i notice @panda was still unmuted at the beginning of the video while he had no radio on him, can we know why he was still unmuted and who was present on this discord call at the time?

This will be the last time I respond if not asked to by a staff member. The voices you hear in the background is my music, I keep it as low as possible and you can hear it throughout the video especially when my loud heater sounds in the background turn off. If I was unmuted then were to mute you would hear the noise discord makes when you deafen yourself. Thank you. Now I wont respond to anyone else unless asked to by staff. Thank you.

Kinda find it odd how it’s being flipped around that I quote “didn’t value my life” meanwhile during the whole situation I’m complying and trying my best as my Roleplay with Cerberus wasn’t giving me much to work with as when I did try to talk to my fellow hostages or a Cerb member I was either Called a “Retard” or “Eyepatch wearing Whore” if I didn’t value my life I to be honest would have tried to escape or something in the woods. I ended up having to literally yell Yes as apparently my “Mhms” and “Yea” wernt herd before.

Hello boydem and gyaldem of dayzrp, the initiation got dropped and everyone escorted the hostages up to the hill, as seen in @Panda's video i am running along side my donny @Elmo trying to give these hostages some roleplay but what we got back was subpar from @Epsilon, he did not take the situation seriously and was warned several times by @Elmo, @Phoenyxx and @RP as well as the rest of the hostage group, however @Epsilon clearly wasn't willing to follow that  when taken hostage as evident from @Panda's video, @Epsilon was told to not kick around the leaves but yet persisted and acted smart, his name was asked and he gave out an  'UHHHHHHHHHHHHHHHHHH UHHHHHHHHHHH' and when asked to stop with kicking the leafs 'YES' was let out to which he was met with the respawn screen.

he claims this is cause his character has an injury but nowhere on his character page does it state this? nor does having an eye injury excuse the fact of him acting the way he was, he was clearly and borderline not interested as evident with his comments like 'this is the first time they've spoke to us in 3 days' as well as the weird 'UHHHH UHHH' and 'YES' he gave as shown in the video and his all round general attitude. we kind of expected more to be honest as we wanted to continue a story line with this group

Good Afternoon Staff & Lurkers,

@Epsilon I find it absolutely crazy that you and your allies think that you were killed just for ‘playing with leaves’ as seen by the title of this report and by your status update. It’s clear you don’t understand why you were killed and I’ll lay it out in my POV for you, which is as follows. Unfortunately I do not have any video evidence.

Cerberus takes some of the government group hostage. I stay on the perimeter of the town, watching to make sure no one is about to play hero for their fellow comrades.

This is where I see @Epsilon strolling up the road from the trainyard. I immediately make the decision that we need to take him as well, given he’s in the same uniform and armband as our hostages. I didn’t want to risk him shooting any of my fellow operators. As he comes closer to me, I initiate. He takes a few seconds to stop and then throws his hands up, however he doesn’t say a word at all. Odd really, normally someone who's taken hostage would ask what’s happening, etc. He was completely silent. So whilst I spoke and gave demands to what appeared to be a brick wall, we started to move into town. Upon entering town, my fellow operator @Squillium meets up with me. Even while Squillium talks to @Epsilon, the hostage remains completely silent. I start having flashbacks to previous interactions with this individual and begin to think this is just going to turn into a meme show.

As we walk up the road towards PD, the individual begins to obnoxiously whistle into his mic. I tell him to stop and a sarcastic comment comes flying out of his mouth about how I’m being hostile. I tell him to shut up because his tone already set my character off and she wasn't about to have this hostage have attitude. Upon having him meet up with his fellow comrades he suddenly can talk full sentences and begins to talk to his fellow comrades. At this point it's clear he’s probably ticked off he was taken hostage which is why he was being less engaging with me. 

We took the hostages over to a fence and lined them up, this was to make sure that they were all stripped of weapons and radios and to get ourselves and them organized. Upon lining them up, some still had gear on them that we wanted them to remove for our safety and to be able to get a good look at their faces. I'm not sure if these individuals were aware but since the 1.10 update you can no longer search people with their hands up, so when we asked for them to take their items off, we got some very sarcastic comments about “why can't you just take it off”. Two individuals, one of which was @Epsilon, made these sarcastic comments instead of just following our demands (mind you while they were very out numbered and defenseless they chose to argue with us rather than just follow orders until we had to get a bit more aggressive).

Several times trying to talk to @Epsilon resulted in me giving up or have to repeat myself several times. You guys claim he’s hard at hearing icly and if I read correctly oocly. I still think that's a poor excuse for me to have to repeat myself SEVERAL times while pointing a fully loaded gun in his face to get a reaction. Truth be told, there were times the OP was hotmicing and I could hear him clicking around and typing which meant that he was likely tabbed out in this situation clearly wanting nothing to do with the situation given his attitude and demeanour the entire situation.

When lined up, I warned him and others about disrespecting and being stupid. We want to be taken seriously and it appeared that some of the individuals in the lineup didn’t want to take us seriously. So after my warning, a few other of my allies warned the individuals as well before we moved them to another location out of town. While we are moving, the flat out trolly behaviour that was apparent from @Epsilon was warned by Elmo and myself again.

We get the individuals lined up against a tree and we wait for them to bring another individual that was injured and slower to keep them all grouped up. While we were standing at the tree, @Epsilon did exactly what his ally perfectly explained. “Decided to have a teenage girl candid photoshoot” and began to play with leaves. I ignored it the first time as @TurkRP tried to interact with him and got mediocre roleplay from the individual and just continued trollyness from him. The second time he played with the leaves, my character had enough and told him to stop. Upon which he didn’t say anything so she asked if he understood, he let out a very trolly and in a disrespectful tone “Uhhh” and thus my character asked again “Do you understand” and he let out another “Uhh” so for the third and final time, my character sternly asked “Do you understand” in which he screeched down his mic and in yet another trolling manner said “YESS” too which my character had enough and decided to put him on a permanent timeout since he wanted to act like a child.

Here are a few things I would like to point out from your POV:

This is not the first time I have dealt with this individual as a hostage. I had once dealt with him as a hostage in Cherno last lore, in which his trolly, nvfl and just flat out childish roleplay was also present. It's a shame after the multiple badrp/nvfl reports you have been in (some guilty and some solved by talking it out) that you still do not know how to roleplay a hostage properly. You showed zero value for your life and acted in a manner that was so childish. Which is a direct break of: 3.2

You make a few ooc jabs such as when I asked you to take off your helmet you say “Can't you just do it yourself” referring to the ability to take things off individuals, too which again its broken whether they knew that or not, should have just listened to the demands of armed gunmen. Then in the video shown, you also say “ this is the most they’ve talked to us in the past 3 days”, another ooc jab it seems.

You also contradict yourself in your POV. In your original post you say that you couldn’t hear what I was asking you but in your last post you say “your mhms and yeas” weren’t heard. So what was it? Was it that you couldn’t hear or you chose not to hear and continue to just troll. 

No where on your character page does it talk about a head injury/eye injury that causes constant migraines. If your character experiences these things, how is he a soldier? How is he performing his duties as one daily? Seems a little odd and more like an excuse to get out of trolly roleplay and avoiding rp. Plus migraines are no excuse for someone to act like a four year old child when they are meant to be an adult, sorry that's not how that works.

We get the individuals lined up against a tree and we wait for them to bring another individual that was injured and slower to keep them all grouped up. While we were standing at the tree, @Epsilon did exactly what his ally perfectly explained. “Decided to have a teenage girl candid photoshoot” and began to play with leaves. I ignored it the first time as @TurkRP tried to interact with him and got mediocre roleplay from the individual and just continued trollyness from him. The second time he played with the leaves, my character had enough and told him to stop. Upon which he didn’t say anything so she asked if he understood, he let out a very trolly and in a disrespectful tone “Uhhh” and thus my character asked again “Do you understand” and he let out another “Uhh” so for the third and final time, my character sternly asked “Do you understand” in which he screeched down his mic and in yet another trolling manner said “YESS” too which my character had enough and decided to put him on a permanent timeout since he wanted to act like a child.

Here are a few things I would like to point out from your POV:

This is not the first time I have dealt with this individual as a hostage. I had once dealt with him as a hostage in Cherno last lore, in which his trolly, nvfl and just flat out childish roleplay was also present. It's a shame after the multiple badrp/nvfl reports you have been in (some guilty and some solved by talking it out) that you still do not know how to roleplay a hostage properly. You showed zero value for your life and acted in a manner that was so childish. Which is a direct break of: 3.2

You make a few ooc jabs such as when I asked you to take off your helmet you say “Can't you just do it yourself” referring to the ability to take things off individuals, too which again its broken whether they knew that or not, should have just listened to the demands of armed gunmen. Then in the video shown, you also say “ this is the most they’ve talked to us in the past 3 days”, another ooc jab it seems.

You also contradict yourself in your POV. In your original post you say that you couldn’t hear what I was asking you but in your last post you say “your mhms and yeas” weren’t heard. So what was it? Was it that you couldn’t hear or you chose not to hear and continue to just troll. 

No where on your character page does it talk about a head injury/eye injury that causes constant migraines. If your character experiences these things, how is he a soldier? How is he performing his duties as one daily? Seems a little odd and more like an excuse to get out of trolly roleplay and avoiding rp. Plus migraines are no excuse for someone to act like a four year old child when they are meant to be an adult, sorry that's not how that works.

It’s Also very bold of you to assume I was trying to avoid Rp or Be a troll along with calling me childish if I wanted to avoid the situation I could have logged out on the hill after my group was initiated on but i didn’t I came down to town with my gun on my back and let myself be taken. As for you’re other insults towards me Here and now and in youre Pov I don’t appreciate them and this shows me that you’re angry for being called out at the end of the day you shot and killed a unarmed complying person. I will admit I’m not always the best at following directions right away  as I can’t always hear the best as I do have a hearing issue outside of IC but I don’t wish to discuss my medical issues to strangers online. 
 

with that I’m done replying to any manors on this topic and will await a verdict Idc about winning or loosing I simply wanted this brought to light.

Wait.. didn't you say you were muted in discord and had no idea that your comrades had been taken hostage...? So really you wouldn't have known of a situation in order to 'avoid it'?

You also came into town with your gun out and put it away just as I asked you to put your hands up, but that's a minor detail.

So anyway queue me vibing in this glorious city of zelenogorsk when i hear an initiation drop on the PD, me being the keen eyed bloke i am spot approximately hella people so not wanting to commit NVFL i throw my hands up and comply to some hostage RP.
After the formalities of patting us down making sure we aren't going to do anything silly they walk us down to a house on the south side of the city where we meet up with our other hostage buddies and are lined up against a fence. This is where things start getting heated between @Phoenyxx and @Epsilon as they are conversing you can tell the tension was rising it was like a story in itself but anyway. We continue up the hill towards the location of the execution Leaf incident and we are told to stand by a tree so i (being the epic roleplayer i am) decide to TextRP that i lean on the tree and that's when @Epsilon does his first emote "Plays with the leafs" to which i stand there observing the private as he was indeed playing with said leafs, after some more talking and RP from the hostage takers he emotes again as the 2nd group of hostage takers bring @ImKrullix over to the situation to which i turn around and ask him "Brat what happened to your leg" in that time @Phoenyxx comes over and starts being angy at @Epsilon about him playing with the leafs, and while i'm talking to @ImKrullix about his injured leg the situation happening behind me escalates but i wasn't paying attention to that as i was engaged in a conversation with my homie @ImKrullix then i hear some gunshots and spin around to see the leaf man @Epsilon dead on the floor. 
After that the situation continued with us being moved to a new location and some more RP 

That's about it really...

Id like to formally request to have this report closed as I really just don't like the ooc tension and over all stress its been causing not to mention i just dont enjoy arguing . It wasn't my intentions to go after anyone and turn this into a big thing ive since the report took a small break and decided to go with the execution of my character (as i see no way of ignoring  being killed ) and starting a new with a new character. I hope everyone has a good weekend and I hope we all can resume rping and have a good time.   Not to mention i dont want any ooc hate between me or any party

SUMMARY

It is a cool November morning in Zelenogorsk, when @Epsilon and his allies are initiated on at the Zelenogorsk PD by members of Cerberus International including @Phoenyxx. The attackers begin to march their hostages towards the forest south of Zelenogorsk. When they reach the woods, they pause near a tree where the OP begins to emote playing with leaves on the forest floor. A short while later, Phoenyxx approaches the OP and orders him not to play with leaves again. The OP mumbles sadly, to which Phoenyxx asks whether he understands. The OP grumbles slightly in disappointment and Phoenyxx once again asks if he understands. The OP then impatiently says "YES" to which he is then gunned down by Phoenyxx.

REASON

Invalid Kill | As stated by multiple POV's, the OP was ordered to behave several times. It is also shown in @Panda's video which shows @Elmo ordering the OP not to start shit and to "shut the fuck up." The OP then decided to play with leaves to which @Phoenyxx commanded him to stop. He responded with two noises meant to convey his disappointment, before Phoenyxx asked him a third time if he understood her command. While his final response was impatient and petulant, we don't see it as contradictory to the previous demands. He was acknowledging the order and was gunned down for it. Being petulant is not a good reason to kill a hostage. For these reasons, we have concluded that this kill is invalid.

BadRP | Many POVs have been brought up which accuse the OP of behaving in a trollish and childish manner. We do not have video of these incidents, and as a result cannot gauge the quality of roleplay which was given by the OP in these scenarios. However, we can gauge the roleplay given by the OP in the video provided by Panda. In this video, we do not see BadRP. The OP is portraying a character with a head injury as well as other injuries. From the perspective of the staff team, we don't see how playing with leaves qualifies as BadRP. 

Metagaming | It was also raised that in the video provided, one can hear what sounds to be someone speaking in the background. Having listened to the video several times, this is not speaking over Discord. It's music.
